I have heard it is a grey area but current amendments seem to be solid.
It's crazy how people could throw people in jail for 20 years over shit that isnt even real. Texas also just passed legislation as well.

I think for the most part it's not because people are bad people, just because most people are straight up retarded. I don't know actually about the laws about that. But I think in most of Europe right now it's illegal. I never jived with the legal systems even for hard shit like murder and theft, but you're right, this is another level of retarded. Arguably more retarded than the drug laws of which I'm not a fan. Good luck everyone. Become an activist if you have time, balls, etc. Or get under the skin of the system, on which I will not elaborate. To the best of my understanding in regards to current case law, a federal judge has thrown out the provisions regarding art as overly broad. There has also been an upholding of it when the art is clearly depicting a real life child. In the latter case, it was additional charges against a re-offending child sex offender who was distributing actual CSAM and making comics depicting neighborhood children that he sold online.

Probably looks like a specific child or is realistic enough, that some would confuse it with reality. Even then I would say no harm is done and respect is fully maintained, but some people are just keen on using violence to solve problems, real or imaginary. The only reason people go to jail is because there is a threat of violence. 99% of them would probably not go there even if sentenced. Same with paying fines. It means creating a depiction (in any medium) of an actual child that exists, and not a child that is a work of fiction. I'm not sure this would stand against the precedent of the US Supreme Court decision on Ashcroft v. Free Speech Coalition since it already seems to rule that standard unconstitutional. The Protect Act was legislation following Ashcroft decision, and was an attempt to override it. Lower courts have rejected parts of the Protect Act, directly citing the prior Supreme Court ruling, but there have also been convictions using the Protect Act, often using its obscenity provisions rather than trying the child pornography provisions. The Protect Act seems to violate quite a bit of decided constitutional law. Its provisions against art have rarely been prosecuted, and have seen mixed rulings in the lower courts. I imagine it might see more use with rise of AI-generated material, and possibly a new challenge in the Supreme Court at some future point.

I would say, just make sure you don't have it on your Android or Windows (iPhones are way too gone to even use in my opinion) if they eventually try to implement client side scanning. Just keep it on an encrypted partition on some Linux computer or something. You can never underestimate the stupidity of people. In Australia I had my phone searched at the airport once after an extended stay in Indonesia. I don't use my phone to fap so I was fine. I had also brought a computer with an encrypted external HDD. They basically asked me to open my gallery and had a scroll through it and asked me where I had been. They seemed to be mostly interested in drug stuff. I had a random screencap on my phone similar to this one and they just scrolled past it without stopping or commenting. However they were extremely interested in a random photo of my passport. Make of that what you will. Having said that I certainly wouldn't risk pushing the boundaries, if I had a whole fucking loli doujin on there I probably would have been fucked lol.

The laptop just sat there on the desk. They scanned it for drug materials and gave it back to me without even turning it on. My encrypted HDD had loli on it but I wasn't worried at all because I could have just told them I wiped it before getting on the plane and it's impossible to prove otherwise.

The loli situation is just fucked all around. Allowing violent videogames but making an exception for rape and loli makes absolutely no logical sense. It's all emotion-based bullshit. That said I have no desire to end up on a sex offender list, so I just mind my own business and jack off privately in my room, maybe send a few donations here and there, which once again has never landed me in trouble.
